1. Acceptance of Terms
Welcome to Fantasy NFT. By accessing or using our platform, you agree to be bound by these Terms and Conditions. These terms govern your use of our fantasy sports league integration service, NFT generation capabilities, and smart contract features. If you do not agree with any part of these terms, please do not use our services.
2. Use of Services
Fantasy NFT provides a platform that connects to your existing fantasy sports leagues from providers like Yahoo, ESPN, and others. Our service automatically generates custom trash talk meme NFTs based on your league performance and facilitates prize distribution through blockchain-based smart contracts. You must be at least 18 years old to use our services and must comply with all applicable laws in your jurisdiction.
3. User Registration
To use Fantasy NFT, you must create an account and connect your fantasy league credentials. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You must immediately notify us of any unauthorized use of your account.
4. NFT Creation and Ownership
When you use our platform, we generate unique NFTs based on your fantasy league performance. These NFTs are minted on the blockchain and are owned by you upon creation. While you own the NFT and its underlying smart contract rights, Fantasy NFT retains certain rights to the meme templates and generation algorithms. You may transfer, sell, or trade your NFTs in accordance with blockchain standards, but you may not use them for commercial purposes beyond personal enjoyment and league trash talk without our express written permission.
5. Smart Contracts and Payments
Fantasy NFT utilizes smart contracts to automatically distribute winnings at the end of your fantasy season. By using our platform, you acknowledge that smart contract transactions are irreversible and that Fantasy NFT is not responsible for transactions once they are executed on the blockchain. You are responsible for ensuring you have sufficient cryptocurrency in your connected wallet to cover any blockchain transaction fees (gas fees). Fantasy NFT does not custody your funds and cannot reverse or modify smart contract executions.
6. User Content
You retain all rights to any content you provide to Fantasy NFT, including your fantasy league information and any customizations you make to generated memes. By using our service, you grant Fantasy NFT a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content solely for the purpose of providing our services and improving our meme generation algorithms. You represent and warrant that you have all necessary rights to any content you provide and that such content does not infringe upon any third-party rights.
7. Prohibited Conduct
You agree not to: (a) use the service for any illegal purpose or in violation of any laws; (b) attempt to gain unauthorized access to our systems or other users' accounts; (c) interfere with or disrupt the service or servers; (d) use automated scripts or bots to access the service; (e) upload or transmit viruses, malware, or other malicious code; (f) harass, abuse, or harm other users; (g) impersonate any person or entity; (h) collect or store personal data about other users without their consent; or (i) use the service in any manner that could damage, disable, or impair our platform.
8. Intellectual Property
All intellectual property rights in the Fantasy NFT platform, including our software, algorithms, meme templates, logos, and branding, are owned by Fantasy NFT or our licensors. You are granted a limited, non-exclusive, non-transferable license to access and use our service in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of our platform except where such restrictions are prohibited by law.
9. Third-Party Services
Fantasy NFT integrates with third-party fantasy sports platforms (such as Yahoo, ESPN, and others) and blockchain networks. We are not responsible for the availability, accuracy, or content of these third-party services. Your use of third-party services is subject to their respective terms and conditions and privacy policies. Any issues with your fantasy league data or blockchain transactions should be addressed directly with the respective third-party provider. We make no warranties regarding third-party services and disclaim all liability for any issues arising from their use.
10. Disclaimers
FANTASY NFT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the service will be uninterrupted, secure, or error-free. We do not warrant the accuracy, completeness, or usefulness of any information on the service. Your use of the service is at your sole risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANTASY NFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (D) ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE; (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT; OR (F) ANY LOSS OR DAMAGE ARISING FROM BLOCKCHAIN TRANSACTIONS OR NFT OWNERSHIP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify, defend, and hold harmless Fantasy NFT, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights or privacy rights; or (d) any content you provide to the service. This defense and indemnification obligation will survive termination of your account and these Terms.
13. Termination
We reserve the right to suspend or terminate your account and access to the service at any time, with or without cause, and with or without notice. Upon termination, your right to use the service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability. You may terminate your account at any time by contacting us. Note that NFTs you have already minted will remain on the blockchain regardless of account termination.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Delaware for the resolution of any disputes arising from these Terms or your use of the service. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. You are advised to review these Terms periodically for any changes. Changes to these Terms are effective when they are posted on this page. Your continued use of the service after any changes indicates your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the service.
